DNA testing has become increasingly important in legal cases, whether for civil or criminal trials, where it is necessary to be able to determine the identity of a person and any family relationships. A DNA test in such cases can be the only scientific proof accepted.

Inheritance Cases

Even with the presence of a will, it is often of required to confirm what family relationships exist. In many countries, children of the deceased are automatically entitled to a share of the moveable estate. This can obviously lead to disputes as to who is and who is not a biological child of the testator; using a DNA test will confirm where a relationship exists. Such testing will provide a court with conclusive evidence, leading to the legacies payable to each child.

Alimony Liability

In family law, there is often financial obligation with children under the age of consent. Again, this can give rise to allegations of parentage or otherwise, which can require positive DNA testing to determine the true facts. The results of such a test can determine whether or not a father is liable for alimony payments, thus highlighting the importance of such tests in the legal process.

DNA Database and Criminal Identification

With the construction and use of DNA databases in many countries well under way, collecting and storing DNA samples for identification purposes is becoming more and more important. With a system set up and in use, offenders (including past offenders) can be more easily identified, providing various law authorities a vital tool in fighting crime.

In a criminal law case where a suspect has allegedly killed a victim, DNA analysis of traces of blood or head hairs can be used to determine without reasonable doubt that the accused was present at the scene or was involved in some regard with the victim’s death. Alternatively, DNA found at the scene of a robbery could be enough to point towards a positive identification of the accused, along with supporting witness testimony to corroborate.

Immigration purposes

Immigration law also relies heavily on DNA testing and DNA test results to prove or establish where family relationships may exist. Without DNA testing facilities, the process of establishing true family relationships in immigration would be painstaking and prone to errors, however with the use of a simple DNA paternity or relationship test, it is now possible to identify relatives and process the visa application in less time.
